1. Agreement to Terms
Welcome to Ubuntu Basketball. These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity, and Ubuntu Basketball, concerning your access to and use of our website, as well as our professional development services including ProLab sessions, individual coaching, film analysis, and virtual support. By engaging with our services or booking a session with Coach Ermay Duran, you acknowledge that you have read, understood, and agree to be bound by all of these Terms and Conditions. If you do not agree with all of these terms, then you are expressly prohibited from using our services and must discontinue use immediately.
2. Intellectual Property and Service Usage
Unless otherwise indicated, Ubuntu Basketball is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the site and provided during coaching sessions are owned or controlled by us. Our specialized training methodologies, including the application of the Constraint-Led Approach, Differential Learning, and representative design, are protected by copyright and trademark laws. You are granted a limited license to access and use the services for your personal, non-commercial player or coach development only.
- Unauthorized recording, reproduction, or distribution of Coach Ermay Duran’s training sessions, film analysis, or proprietary curriculum without express written consent.
- Using our training materials, methodologies, or intellectual property to establish a competing basketball development service or commercial enterprise.
- Engaging in behavior that disrupts the learning environment of the ProLab or clinics, or failing to adhere to safety protocols during physical training sessions.
3. Disclaimer and Limitation of Liability
Ubuntu Basketball provides high-performance athletic training and educational content on an 'AS IS' and 'AS AVAILABLE' basis. While we apply advanced Movement Sciences and psychology to our methods, participation in basketball training involves inherent physical risks. To the fullest extent permitted by law, Ubuntu Basketball and its staff shall not be liable for any direct, indirect, or consequential damages, including personal injury or property damage, arising from your participation in our programs. We do not guarantee specific athletic outcomes or professional placements, as results depend on individual effort, physical condition, and consistency.
4. Governing Law, Modifications, and Contact
These Terms and Conditions and your use of our services are governed by and construed in accordance with the laws of the Netherlands. Any legal action or disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Amsterdam.
Ubuntu Basketball reserves the right to modify these terms at any time to reflect changes in our services or legal requirements. We will notify users of changes by updating the 'Effective Date' of these terms. Your continued use of our services after such changes signifies your acceptance of the new terms.
